But it is best that everyone understands how things work, who does what and when, and what happens if something goes wrong.

Any photoshoot booked will work according to the terms and conditions.

Cancellation & Rescheduling Policy:

• To confirm a booking, a minimum of a 50% deposit is required before the shoot. Due to the digital nature of photography, all sales are final once final images have been delivered.

• If the client cancels or reschedules within 72 hours of the shoot for a reason not deemed an emergency, the full payment is forfeited. If an emergency occurs, up to 50% may be refunded at the photographer’s discretion.

• If the client is late due to an emergency, the shoot will still end at the originally scheduled time. Missed time cannot be extended or refunded.​​​

GOOD FAITH SATISFACTION GUARANTEE:

If you're not thrilled with the final images, and you have a reasonable, clearly explained concern, I’ll refund all the profit I made from the shoot. This excludes hard costs like travel, assistants, props, etc. The concern must be raised within 3 days of delivery. This guarantee doesn’t apply to changes in taste or direction after the shoot, and doesn’t override the original creative brief we agreed on.

TIMING:

Regarding time in a shoot, if you come 30 minutes late, you miss out 30 minutes of the shoot, and that money will not be refunded. Please arrive at least 30 minutes early to a shoot.

RIGHTS:

The photographer holds the right to retain, reproduce, post on social media and on this website all photos taken of the client, unless a contract is otherwise signed by both photographer and client. 

In accordance with South Africa’s Copyright Laws, the copyright of all images created by the Photographer is owned by the Photographer. Jayden Collier Photography retains all copyright benefit for all images created by himself forever.

The Photographer reserves the right to amend these Terms and Conditions without prior notice.

If one of the images created by our photographers is used for any commercial or financial gain purpose, at any time, without our permission in writing, you agree to pay us for the use of the image at the current market rate as determined by the use at the time.

Example: You send a magazine an image created by the Photographer, Jayden Collier, the magazine pays you for the image. You owe Jayden Collier Photography 100% of that payment + liquidated damages, on-demand.

PHOTO PURCHASING TERMS:

• Payment and Delivery

  • All photos must be paid for in full before delivery.

  • Upon receipt of payment, high-quality images will be transferred via a secure method (e.g., WeTransfer).

• Usage Rights

  • Purchased photos include only the rights specified in the agreement.

  • Unauthorized reproduction, resale, or modification of the image is strictly prohibited unless explicitly agreed upon in writing.

• Exclusivity and Licensing

  • Exclusive rights grant the buyer sole usage of the image, and neither party may license or sell it to others.

  • Non-exclusive rights allow the buyer to use the image, but the photographer retains the right to license or sell it to other parties.

  • For other licensing arrangements (e.g., editorial, commercial, or joint partnership), specific terms will be outlined in the agreement.

• Refunds and Cancellations

  • Due to the digital nature of the product, refunds are not provided once the image has been delivered.

  • Cancellations before delivery may be subject to a cancellation fee to cover any incurred costs.

• Customization and Revisions

  • Any requested edits or customizations must be agreed upon in writing and may incur additional charges.

• Limitations of Liability

  • The photographer is not responsible for any issues arising from improper use or alteration of the images by the buyer.

  • Images are delivered in high quality; any printing or usage quality concerns must be addressed with the respective service provider.

• Acknowledgment of Terms

  • By purchasing a photo, the buyer acknowledges and agrees to these terms and conditions.
